This website is operated by Oz Bargain Outlet, an Australian business. Where these terms use "we", "us" or "our", they refer to Oz Bargain Outlet. "You" means the person using the site or placing an order.
2. Orders
Placing an order is an offer to buy. A contract forms when we send you a dispatch confirmation, not when you receive an order confirmation email. We may decline or cancel an order — for example if an item is out of stock, if there's a pricing or description error, or if we suspect fraudulent use of a payment method. If we cancel an order you've already paid for, we'll refund you in full.
3. Pricing
All prices are in Australian dollars and include GST where applicable. We try to keep pricing accurate, but if an item is listed at an obviously incorrect price we'll contact you before processing and give you the choice to proceed at the correct price or cancel for a full refund. Prices can change without notice, though changes won't affect orders already accepted.
4. Product Information
We take care to describe products accurately, including specifications supplied to us by manufacturers. Photographs are illustrative — colours may appear differently on your screen, and measurements may vary slightly. If a product arrives materially different from its description, your rights under the Australian Consumer Law apply and you should contact us.
5. Payment
Payment is processed by third-party providers through our checkout. We don't store your full card details. You warrant that you're authorised to use the payment method you provide.
6. Delivery, Returns & Refunds
Delivery and returns are covered on our Shipping & Delivery and Returns & Refunds pages, which form part of these terms. Risk in the goods passes to you on delivery.
7. Your Consumer Guarantees
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms limits or excludes those rights.
8. Safe Use Of Products
Some items we sell are power tools, garden equipment or products with sharp parts. Read the manufacturer's instructions and safety warnings before use, wear appropriate protective equipment, and keep them away from children. Use products only for their intended purpose.
9. Limitation Of Liability
To the extent permitted by law, and apart from the consumer guarantees described above, our liability for any claim relating to a product is limited to replacing the product, supplying an equivalent, or refunding the purchase price. We're not liable for indirect or consequential loss.
10. Intellectual Property
The content on this site — text, images, layout and branding — belongs to us or our suppliers. You may view and print pages for your own use, but not reproduce or republish them commercially without our permission.
11. Acceptable Use
Don't use this site for anything unlawful, attempt to interfere with its operation, or use automated tools to scrape it. We may restrict access if you do.
12. Changes & Governing Law
We may update these terms from time to time; the version published when you order is the one that applies. These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of its courts.
